1. Acceptance of Terms
By accessing or using TasteBud Kitchen you confirm that you are at least 13 years old (16 in the EU/EEA), have read and agree to these Terms and our Privacy Policy, and have authority to agree on behalf of any organization you represent.
2. Description of Service
TasteBud Kitchen is a cooking assistant application that allows you to store, organize, and share recipes; plan meals; generate shopping lists; track cook history; use AI-powered recipe generation and photo creation; browse the Cottage Market; and connect with other home cooks.
3. User Accounts
3.1 Account Creation
You must provide a valid email address and password. You are responsible for maintaining your credentials and all activity under your account.
3.2 Demo Mode
A limited demo is available without registration. Demo data is not persisted between sessions.
3.3 Termination
We may suspend or terminate accounts that violate these Terms, at our discretion, with or without notice.
4. User Content
4.1 Your Ownership
You retain ownership of all recipes, photos, and content you create. By submitting content, you grant TasteBud Kitchen a non-exclusive, worldwide, royalty-free license to store, display, and distribute your content solely to provide the Service.
4.2 Public Content
Cookbooks and recipes marked public are viewable by all authenticated users. You may make content private again at any time.
4.3 Prohibited Content
You agree NOT to submit content that infringes intellectual property rights, is false or fraudulent, is obscene or harassing, violates any law, or contains malware or spam.
4.4 Community Content & Auto-Publishing
TasteBud Kitchen includes community features. If you use a free account, the recipes you create are shared to the public "Official TasteBud Cookbook" so the community can discover them. Premium subscribers' recipes remain private unless they choose to share. By creating content on a free account, you consent to it being published to the community after an automated content check.
4.5 Zero Tolerance for Objectionable Content & Abusive Users
To keep the community safe, we:
- Screen content automatically before it is published, and reject or remove content that violates these Terms;
- Provide a Report control on community content and a Block control to hide other users;
- Review reports and act on objectionable content within 24 hours, including removing the content and/or ejecting the user who provided it;
- May ban users who violate these Terms, preventing them from posting or publishing further content.
By using the community features you agree to these Terms and acknowledge that violations may result in immediate content removal and account termination.
5. Premium Subscription
5.1 Pricing
- Monthly: $6.99 per month
- Annual: $59.99 per year (~28% savings)
5.2 Billing
Subscriptions are billed through the Apple App Store or Google Play Store. All billing, refund, and cancellation terms are governed by the respective platform's policies.
5.3 Cancellation
Cancel anytime through your App Store or Google Play subscription settings. Access continues through the end of the current billing period. No partial refunds unless required by law.
5.4 Price Changes
We will provide at least 30 days' notice before price changes affecting existing subscribers.
6. AI Features
6.1 AI Recipe Generation
AI-generated recipes may not always be accurate or complete. Review all AI content before cooking, especially regarding food safety and allergens.
6.2 AI Photo Generation
Photos generated by DALL-E 3 are for personal, non-commercial use within the app. Images may not perfectly represent the actual dish.
6.3 Nutrition Analysis
Nutrition data is an estimate only. Do not rely on it for medical, dietary, or health decisions. Consult a qualified healthcare provider for medical dietary advice.
7. Cottage Market
7.1 Seller Responsibilities
Sellers are solely responsible for compliance with all local, state, and federal cottage food laws and regulations; obtaining required licenses and permits; accurate product and allergen descriptions; fulfilling transactions; and collecting and remitting applicable taxes.
7.2 No Transaction Processing
TasteBud Kitchen does not process payments between buyers and sellers. The Cottage Market is a listing/discovery platform only. All transactions occur directly between buyers and sellers.
7.3 No Liability for Transactions
TasteBud Kitchen is not responsible for the quality, safety, legality, or delivery of Cottage Market items, nor for buyer-seller disputes.
8. Intellectual Property
TasteBud Kitchen, its logo, design, code, and features are our property and protected by intellectual property laws. You may not copy, modify, or distribute them without our written consent.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TASTEBUD KITCHEN SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE PRECEDING 12 MONTHS OR $50 USD.
11. Indemnification
You agree to defend and hold harmless TasteBud Kitchen from claims, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Governing Law
These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration under AAA rules, except either party may seek injunctive relief in court. You waive the right to participate in class action lawsuits.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via in-app notice or email at least 14 days in advance.
